By placing an order with “Emma Jane Cake Design” (ABN 99 679 505 350), you, the Customer, are agreeing to the following terms and conditions. Please read and understand the obligations that we have to each other as these terms and conditions form an agreement between us.
QUOTES & 50% PART PAYMENT
Please note that quotes are valid for 30 days only. Should you accept a quote beyond this time frame, the quote is subject to change/increase.
To secure a quote/date, a 50% part payment is payable by bank transfer, details of which are included on the quote. Your date is not secure until this payment has been received. The part payment is non-refundable.
PAYMENT
The remaining balance is payable, in full, up to four weeks prior your event date by bank transfer, details of which are included on the quote.
Failure to pay the full balance will mean that “Emma Jane Cake Design” is not obligated to bake/start or fill your order.
It is your obligation to ensure that the remaining balance is paid on time. Should “Emma Jane Cake Design” be unable to reach you due to non-payment of the balance, your order will be cancelled.
CANCELLATIONS/DATE CHANGES/POSTPONEMENTS
Any cancellation of your order for any reason including but not limited to illness, forces (either natural or human), natural disasters or phenomenon, unforeseen or uncontrollable events must be received in writing and received a minimum of 3 months prior to the booked date.
In the event that an order is cancelled with the correct time frame, you confirm that: the 50% part payment is non-refundable, refund of the remaining balance is at the complete discretion of “Emma Jane Cake Design” and if issued, will be done minus any/all items that have already been purchased to complete the order. This can include edible components, ingredients or any other decorative items that were required to be pre-purchased.
Should your event be cancelled within three months of your booked date, you confirm that the total amount is non-refundable.
Should your event date need to be changed or postponed for any reason including but not limited to illness, forces (either natural or human), natural disasters or phenomenon, unforeseen of uncontrollable events, “Emma Jane Cake Design” agrees to transfer your order to a new date subject to “Emma Jane Cake Design” being available to do so.
If a new date is confirmed by “Emma Jane Cake Design” for reason of date change or postponement, any funds already paid towards the total order fee will be transferred to the new date. A $150 postponement fee is applicable to each and every date change or postponement. You may also be liable to incur the cost of price increases reflective of the new date.
If a new date is not available due to “Emma Jane Cake Design” being unavailable, “Emma Jane Cake Design”
reserves the right to refuse to reschedule and you understand that full payment of the
order fee is still due.
Orders must be finalized within two years.
REFUNDS
Refund of any amount of the quoted price is at the complete discretion of “Emma Jane Cake Design”.
No refund will be offered for “change of mind” prior to the order being commenced/completed.
Refunds will only be paid in instances where a significant outcome has occurred or there has been serious dissatisfaction with the product. In order to request a refund, photographic evidence and a sample of the completed order will need to be returned to “Emma Jane Cake Design” within 24 hours of the event date. “Emma Jane Cake Design” will then consider the request and takes steps to negotiate a resolution of the
issue.
DESIGN
"Emma Jane Cake Design"will not identically copy another sourced design.
"Emma Jane Cake Design" will make every effort to create a product that follows and meets your inspiration/design brief. However, you accept that being a handmade product, there may be circumstances in which
“Emma Jane Cake Design” may need to change the design to adhere to the desired brief. This may be due to circumstances outside of the control of “Emma Jane Cake Design” including weather/high humidity, venue environment, no refrigeration available, availability of decorative items, delivery times etc.
Any major changes will be discussed with you in advance if possible.
Excessive alterations to your order, regardless of when the request for alteration comes in prior to your event date, will incur a $100 alteration fee to be paid to “Emma Jane Cake Design” by bank transfer prior to delivery of the order.
PICKUP
Cakes are to be collected at the agreed date and time from our premises. Late pick ups will not be available due to tight schedules with other deliveries/pick ups.

DELIVERY
The quote provided by “Emma Jane Cake Design” will make it clear whether delivery is included in
the total order fee. Delivery fee is $1 per Kilometer return. “Emma Jane Cake Design” takes every precaution that it can to ensure that your order is delivered at the requested time, to the requested venue and structurally sound.
Once “Emma Jane Cake Design” has delivered your order to the venue nominated by you, it will be set up in the agreed location unless display conditions (direct sunlight, insects, weather) require it to be stored in an area nominated by venue staff/event coordinator. "Emma Jane Cake Design” will not be held liable for any damage to your order that may occur once delivered/set up. Any liability will be on venue/yourselves.

COLLECTION
If you choose to collect your order from “Emma Jane Cake Design”, we will no longer be responsible
for your order once you collect it. You, or the person you nominate to collect your order, will be liable for any damage caused by the travel or storage of your order. “Emma Jane Cake Design” will give you as much guidance as possible when you collect your order to ensure that you can safely transport it. I also supply non-slip mat and set it up in your vehicle.
Always ensure it is on a flat surface such as the foot well of your vehicle if big enough, an open boot area or bring a heavy chopping board and three bath towels to set it up flat on your car seat.

Transport with the air conditioning on and set to as cold as you can. Never leave the order sitting in
vehicle for any extended amount of time.

Drive with caution and no heavy braking.
STORAGE
“Emma Jane Cake Design” always creates orders of the highest quality and any orders are best eaten the day of the event. “Emma Jane Cake Design” will always provide you with advice in regards to storage and display.
All ganache/fondant cakes can be stored at room temperature in a cool, dark location or air conditioned room.
All buttercream cakes can be stored in the fridge but should be allowed to come back to room temperature at least 1 hour before eating depending on the size of your cake.

ORDER DECORATION/STANDS
If your order requires fresh flowers, they can be supplied by myself or your florist, I strongly suggest your florist to supply them if they are to match. "Emma Jane Cake Design" takes no responsibility for the condition/amount of the flowers supplied by your florist.
Additional decorations can be ordered by “Emma Jane Cake Design” including cake toppers.
Display stands will be an additional cost to you and will be included on the quote. Bonds are required for cake stands and are non-refundable should they be damaged. Once collected, if in perfect condition your stand bond will be refunded within 7 days from the pick up date.
Please note if your venue has a midnight bump out time for vendors you will be liable for the cake stand and will return it to my home address within 7 day's.
ALLERGIES
“Emma Jane Cake Design” does not have a 100% allergy free kitchen. We ask that you advise us on requesting an order to see what allergies can be catered for.
The products all contain allergens including dairy, wheat, soy, gluten, eggs and more. You agree to notify your guests, venue and any other suppliers of this risk.
“Emma Jane cake Design” is not held responsible for any allergic reactions as all potential allergen
risks are discussed with you at the time of an order request.
SOCIAL MEDIA
“Emma Jane Cake Design” reserve the right to take photos of your order and use these images in their social media, website and advertising. If professional photo's are provided your photographer will be tagged in the photo.
